What Is An End User License Agreement

3.1. Cisco Technology in General. Except as expressly agreed by Cisco, you may not (a) transfer, sell, sublicense, monetize, or make available the features of Cisco Technology to any third party; (b) use the Software on used or refurbished Cisco equipment not authorized by Cisco, or use software licensed for a particular device on another device (except as permitted by Cisco`s Software Licensing Portability Policy); (c) remove, alter or obscure any trademarks, copyrights, proprietary notices, intellectual property notices or other trademarks; (d) reverse engineer, decompile, decipher, disassemble, modify or create derivative works of Cisco technology; or (e) use Cisco Content other than to the extent permitted by your authorized use of Cisco technology. This End User License Agreement (”EULA”) is a legal agreement between you as a licensee and carbonTRACK Ltd ACN 120 475 505 (”carbonTRACK” or ”we” or ”us” for the software (”Product Software”) of the carbonTRACK product (”Product”). Subject to the terms of this EULA, carbonTRACK grants you a limited, non-exclusive license (without sublicense) to make one (1) copy of the Product Software only in the form of executable object code only on the Product you own or control and only for use in connection with the Product for personal use. You may not transfer your rights and/or obligations under the EULA unless you have carbonTRACK`s prior written consent. Neither party shall be liable for any indirect, incidental, exemplary, special or consequential damages; loss or corruption of data or business interruption or loss; or loss of revenue, profits, goodwill or expected sales or savings. Each party`s maximum aggregate liability under this EULA is limited to (a) for claims arising solely from perpetual software, the fees cisco receives for such software; or (b) for any other claim, the fees received by Cisco for the applicable Cisco technology attributable to the 12-month period immediately preceding the first event giving rise to such liability. One. Scope of License: Licensor grants you a non-transferable license to use the Licensed Application on Apple-branded products that you own or control and that are permitted under the Terms of Use. The terms of this standard EULA apply to any content, materials or services accessible through the Licensed Application or purchased in the Licensed Application, as well as upgrades provided by Licensor that replace or supplement the original Licensed Application, unless such upgrade is accompanied by a custom EULA. .
